CONDITIONS OF SALE

Any participation in the auctions shall involve the unconditional acceptance of the following conditions of sale. These conditions of sale shall be displayed in the sales room both during the exhibition and at the time of the sale, and shall be reproduced on the backs of the invoices and in the catalogues, and read aloud in public by the bailiff before each sale:

  1. The last highest bidder shall be the purchaser. He or she shall have the obligation to pay the lot's purchase price in cash, marked up by 25% for expenses and VAT without prejudice to the droit de suite when the latter applies to the work.
  2. The ROPS Sales Room reserves the option of refusing any bid and of proceeding with any decision, meeting or lot withdrawal without having to justify its decision.
  3. Any indications appearing in the catalogues, advertisements, brochures or any other written material emanating from the sales room must be regarded as simple indications that do not in any way engage the ROPS Sales Room's responsability. The latter guarantees neither the exactitude of any statement relating to the author, nor the origin, date, age, attribution, source, weight or material condition of the lot. No ROPS Sales Room employee is authorised to give guarantees in this respect. Consequently, purchasers must satisfy themselves before the sale as to the nature of the lots and their material condition.
  4. The profits and risk pass to the purchaser from the time of the sale by auction. He or she will however only become the owner at the time of the complete payment of the price and its accessories. Any complaint must, under penalty of inadmissibility, reach us by registered letter within ten days of the sale by auction.
  5. In the event of disputed or erroneous sale by auction, the lot shall be re-auctioned. The officiating bailiff shall settle supremely and without appeal any dispute that may occur about the bids during the sale.
  6. Purchasers shall be required to pay for and take possession of their allocated lots within five working days of the session. Beyond that period of time, the ROPS Sale Room reserves the right, without prior formal warning , either to re-auction any paid for but uncollected lots, or to have them transferred to a furniture depository at the purchaser's risk and expense. Without prejudice to pursuits for payment from the defaulting purchaser, the lots unpaid within the aforementioned period time could be re-auctioned on the grounds of an irresponsible bid as soon as the ROPS Sales Room thinks fit. In this case, the purchaser shall be required to pay any possible difference in price as well as all expenses and outlays relating to the sales required for the possibility  of re-allocating the lot. He or she shall be unable to claim any excess, should there be any.
  7. Invoices and statements of account are payable in cash. Any sum unpaid at its due date shall earn full post maturity interest without prior formal warning at a rate of 2% per month. Moreover, in the event of non-payment at the due date, the amounts due shall automatically be increased by a fixed indemnity of 15% by way of legal damages, with a minimum of 75 euros excluding the post maturity interest. Furthermore, these charges shall be added to a custody charge of 3 euros per lot per day with a minimum of 30 euros.
  8. Any successful bidder shall be deemed to have acted on his or her own account and shall be personally liable for the payment of the lots allocated to him or her in whatever capacity. He or she shall have to discharge the amount in Euros, by Visa, MasterCard, AmericanExpress, Bancontact, or by certified cheque, before collection and within the period of time envisaged for this purpose at Clause 6.
  9. All our sales to EEC nationals are subject to the particular margin system, with non-deductible VAT.
  10. If you are unable to attend the public sales, you could fill out a buying order, but in this case, offers cannot be less than 30 Euros. We could also telephone you during the sale, for lots where the bidding starts at 80 euros.
  11. In the event of litigation, only the Courts of Namur shall have jurisdiction.
